James Brown to Matthew Wilson - Part of Two Shepherdsville Lots

In 1833, via a Circuit Court decree, William Jones as commissioner deeded to Matthew Wilson, assignee of Joseph Bowman, a part of two Shepherdsville lots (#39 & #40) from the estate of James Brown deceased. This was following a court suit brought by Elizabeth Griffin against the Brown estate.

Whereas the Bullitt Circuit Court in the case of Elizabeth Griffin against James Brown's heirs decreed that lots number thirty-nine and forty should be sold to satisfy the demand of said Griffin and in said decree appointed John W. Beckwith, Weir Tilford and William Jones commissioners to divide said lots and sell them out. In pursuance of which decree the said commissioners divided said lots 39 and 40 in the new plan of the Town of Shepherdsville into five lots fronting Main Street and running back across both lots to School Alley and numbered said lots on their plat of division one, two, three, four & five and sold said lots at public sale and Joseph Bowman purchased lot number five on said plat and the commissioners returned to said court a report of their proceedings and said commissioners were also directed in said decree to convey the said lots to the purchasers whenever the purchase money should be paid. All which will more fully appear by reference to the record and proceedings of said suit.

And whereas also since the sale aforesaid the said Joseph Bowman paid up to said commissioners the purchase money and sold the said lot five to Matthew Wilson, but no deed has yet been made. The said John W. Beckwith, one of the commissioners having departed this life, and the said Weir Tilford, commissioner aforesaid, having moved from the said Bullitt Circuit and County, the Circuit Court at their session on the 8th day of October 1833 appointed the said William Jones commissioner to convey to the purchasers the lots so sold as aforesaid.

Now this indenture made this eleventh day of October (1833) one thousand eight hundred and thirty-three between the said William Jones, commissioner, as aforesaid of the County of Bullitt and State of Kentucky of the one part and the said Matthew Wilson of the same county and state of the other part, witnesseth that the said William Jones, commissioner as aforesaid, for and in consideration of the promises and the payment of the purchase money, hath and by these presents doth grant, alien, release, convey and confirm unto the said Matthew Wilson the lot five on the commissioners' plat parts of lots No. 39 & 40 in the new plan of the town of Shepherdsville and bounded as follows to wit.

Beginning on Main Street of said town at the southeast corner of said lot No. 40, thence with the line of the alley North eighty-three and a half degrees West one hundred and ninety-eight feet, eleven inches to the southwest corner of lot number thirty-nine on School Alley, thence with a line of said alley, North six and a half degrees East thirty-nine feet eight and three-quarter inches to a stake thence South eighty-three and a half degrees East one hundred and ninety-eight feet, eleven inches to a stake on Main Street, thence with the line of said street thirty-nine feet, eight and three-quarter inches to the beginning To have and to hold the said described and bounded part of lots No. 39 & 40 with all the appurtenances thereunto belonging unto him the said Matthew Wilson, his heirs, executors, administrators and assigns and to his and their only proper use, benefit and behoof forever. Hereby warranting and defending the same to the said Matthew Wilson, his heirs, executors and assigns as far as by law and the decree of said court, he is bound to warrant and defend and no farther. In testimony whereof the said William Jones hereto sets his hand and seal on the day and year within written. (signed) William Jones.

State of Kentucky, Bullitt Circuit Court, 11 Oct 1833. This indenture was this day produced in open court and acknowledged by William Jones, grantor and commissioner, therein named to be his act and deed for the purpose therein mentioned and the same was ordered to be recorded. Whereupon I the clerk of the Bullitt Circuit do certify that I have truly entered the same of record in my office. Att. Noah C. Summers, clerk.
