Patrick McGee to Benjamin Pope, Jr. - The Ferry Tract

Patrick McGee and Benjamin Pope Sr. had an arrangement regarding the tract of land known as the "ferry tract," and in the summer of 1800, McGee formalized it by deeding the tract to Pope's son, Benjamin Jr. A transcription of that deed is given below, together with an image of the deed itself. Inserted in the transcription are numbers in brackets that refer to locations marked on the plat drawing, also shown below. To read about the Ambrose deed, follow this link.

This indenture made this twenty sixth day of June in the year of our Lord eighteen hundred between Patrick McGee and Rachel his wife of Nelson County & State of Kentucky of the one part and Benjamin Pope Junior of Bullitt County and state aforesaid of the other part. Witnesseth whereas the said Patrick McGee by bond bearing date the nineteenth day of October, seventeen hundred and eighty six was bound unto a certain Benjamin Pope his heirs and assigns for the conveyance by bond of a good and sufficient deed or deeds of conveyance for four hundred and fifty acres of land lying in the County of Bullitt on Salt River and known by the name of the Ferry Tract; now whereas the said Benjamin Pope for a valuable consideration to him in hand paid to the assigned the said bond unto Benjamin Pope Jr., Now this indenture witnesseth that the said Patrick McGee & Rachel his wife for and in consideration of the premises and the sum of one dollar the current coin of the United States to him in hand paid by the said Benjamin Pope Jr., the receipt whereof is hereby acknowledged, has bargained and sold, aliened, conveyed and confirmed and by these presents do grant, bargain, sell, alien, convey, transfer & confirm unto the said Benjamin Pope Jr., his heirs and assigns, the aforesaid Ferry Tract of land being bounded as follows. [1] Beginning at a sugar tree, Spanish oak and two beeches standing on the bank of Salt River, a corner of Nathan Miles' fifty acres which was laid off to Jacob Ambrose for said Miles and Simmons, thence South twenty three degrees East five hundred poles to [2] a white oak and hickory, thence North sixty seven East one hundred and thirty one poles to [3] two white oaks and ash, thence North twenty four West (for twenty three) two hundred and ninety two poles with Richard Simmons' line to [4] an elm, beech & hickory, thence North sixty seven East fourteen & a half poles with Richard Simmons' line to [5] a beech, thence North twenty three West two hundred and fifty two poles to [6] a Spanish oak & dogwood on the bank of Salt River, thence down with the several meanders of said river one hundred and forty three poles to the Beginning, containing and laid off for four hundred and fifty acres of land be it more or less by a survey made by a surveyor of Bullitt County, to have and to hold the same with all the appurtenances unto the said Benjamin Pope Jr., his heirs and assigns to his and their only proper use & benefit & behoof, and the said Patrick McGee and Rachel his wife for themselves, their heirs do covenant and agree to and with the said Benjamin Pope Jr., his heirs and assigns that they the said Patrick McGee, Rachel his wife & their heirs will warrant and forever defend from themselves, their heirs and all and eery other person or persons claiming under them forever the said tract of land with all the appurtenance unto the said Benjamin Pope Jr., his heirs and assigns, against the claims of the said Patrick McGee and Rachel his wife, their heirs or assigns. In witness whereof the said Patrick & Rachel his wife have hereunto set their hands and seals on the day & year above mentioned. (signed) Patrick McGee

The words "bond" in the 16th line, "river" in the 28th, "fifty acres which was laid off to Jacob Ambrose for said Miles & Simmons" between the 28th & 29th, & the words "covenant and agree" in the last page were interlined before signed. (signed) Patrick McGee

I Thomas Speed, Clerk of the County Court for said County, do certify that the foregoing deed with the above memorandum was acknowledge by Patrick McGee to be his act and deed before me on the 27th day of June 1800, and that the same is recorded in my office. (signed) Tho Speed
