Alexander Ralston to Rufus K. Summers - Shepherdsville Lot 61

When Alexander Ralston failed to pay his town tax on lot 61 in 1828, it was sold for taxes to George L. Robards who then sold it to Rufus K. Summers, as shown in the first deed below. For some reason, the lot was again deeded to Summers in 1834 as shown in the second deed below. A decade later in 1838, Summers sold it to Preston Hornbeck.

Whereas the trustees of the town of Shepherdsville levied a tax for the year 1828 on the lots in said town and directed Brooky Barker, the collector of said tax, to sell the said lots or so much thereof as would be sufficient to pay and satisfy the said tax; and whereas the tax so levied and laid on lot No. 61 in the new plan of said town which had been listed for taxation in the name of Alexander Ralston as owner, not having been paid by the said Alexander Ralston or any person for him, the said Brooky Barker, collector as aforesaid, after having advertised in the manner directed by said trustees, did in market overt publicly sell the said lot Number 61, and George L. Robards purchased the whole of said lot for the sum of nine cents, that amount being the tax due on said lot for the year 1828; the said sale having been made on the 2nd day of August 1828. And whereas also since the sale aforesaid the said Brooky Barker, collector as aforesaid, give to the said George L. Robards a certificate of said sale and purchase, which certificate the said George L. Robards has for the consideration of ten dollars assigned to Rufus K. Summers, the time for redemption of said lot having expired, all which will appear by the said certificate and assignment as follows.

"I Brooky Barker, collector of the taxes levied on the lots in the town of Shepherdsville for the year 1828, do certify that on the second day of August 1828, after having advertised as by directed by the trustees of said town, I sold lot number 61 in the new plan of said town for the sum of nine cents and George L Robards became the purchaser of said a lot; said lot having been listed for taxation in the name of Alexander Ralston as owner. August 2, 1828 (signed) Brooky Barker."

"For value received, I assign the within certificate to Rufus K. Summers, July 6th 1831, for the consideration of $10, the time for the redemption of said lot having expired. (signed) George L. Robert."

This indenture therefore made this third day of April 1832 between the said Brooky Barker, late collector of the town taxes of Shepherdsville, of the one part and the said Rufus K. Summers of the other part. Witnesseth that the said Brooky Barker, collector as aforesaid, for and in consideration of the sale and purchase aforesaid, the payment of the purchase money, the assignment aforesaid, and the power vested in him, have granted, aliened, released, conveyed and confirmed, and by these presents, doth grant, alien, release, convey and confirm unto the said Rufus K. Summers all the right, title, interest, and claim of the said Alexander Ralston of, in and to the said lot number 61 described as aforesaid.

To have and to hold the said lot and appurtenances thereunto belonging to him, the said Rufus K. Summers, his heirs, executors, administrators and assigns, and to his, and their only proper use, benefit and behoof forever. The said, Brooky Barker, late collector as aforesaid, hereby only warrenting and defending as far as by law he is bound and no further.

In testimony whereof the said Brooky Barker, late collector as aforesaid, hereto sets his hand and seal on the day and year within written.

Whereas on the 2nd day of June 18, 1827 22 feet of lot No. 61 in the new plan of the town of Shepherdsville was sold as the property of Alexander Ralston by F. Kalfus, the then collector of the town aforesaid for the tax due on said lot for the year 1827, and George L. Robards became the purchaser. And on the 2nd day of August 1828 the balance of said lot was sold as the property of said Ralston by Brookey Barker the then collector of said town for the tax due on said lot for the year 1828, and the said Robards became the purchaser thereof.

And whereas also since the sales aforesaid the said Kalfus and Barker have gone out of office, and William B. Holsclaw has been appointed collector of said town, and the said Robards has by order filed with the papers of the trustees of said town directed a deed to be made to Rufus K. Summers for said lot and the trustees have by an order made on their minute book on the 17th day of December 1834 and directed the collector to make said deed.

This indenture therefore made this 22nd day of December 1834 between the said William B. Holsclaw, collector of the town of Shepherdsville of the one part, and the said Rufus K. Summers of the other part.

Witnesseth that the said William B. Holsclaw, collector as aforesaid, for and in consideration of the premises and the power vested in him by law, and the orders of the said trustees, have granted, aliened, released, conveyed, and confirmed, and by these presents do grant, alien, release, convey and confirm unto the said Rufus K. Summers all the right, title and interest of the said Alexander Ralston of in and to the said lot (No. 61) sixty-one in the new plan of the town of Shepherdsville aforesaid.

To have and to hold the seed a lot of ground and appurtenances unto him the said Rufus K Summers, his heirs and assigns, and to his and their only proper use, benefit and behoof forever, here by warranting and defending the same to the sad Rufus K Summers, his heirs and assigns as far as by law he is bound to warrant and defend and no farther, and without individual responsivity for the title on him, they said William B. Holsclaw, his heirs &c.

In testimony whereof the said William B. Holsclaw, collector aforesaid, hereto sets his hand and seal the day and year within mentioned.
