Shepherdsville Trustees to Whitledge Overall - Lot 87

After Third Street was reduced from 80 to 40 feet wide, and new half-sized lots were added to the north, the trustees began selling them. As shown below, they sold lot No. 87 to Whitledge Overall. However, by the time this deed was recorded, it had already been so to Rufus K. Summers for taxes due.

Whereas the Legislature of the State of Kentucky by an act passed on the 11th day of December 1793 vested 50 acres of land lying on the north side of Salt River at the falls of said river an Nacy Brashear, Samuel Crow, Michael Troutman, Frederick Penebaker, Benjamin Stansbury, Joseph Brooks and John Essery as trustees for the purpose of laying off a town, in pursuance of which the said trustees laid out the the town of Shepherdsville and made out and returned a plan thereof by which they made Third Street eighty feet wide; and whereas also the successors of the said trustees had a resurvey of said town and made out a new plan thereof by which the said Third Street was reduced to forty feet wide, leaving to the trustees a strip of 40 feet wide in the north side of said town on said street, which plan and acts of the said trustees were confirmed by an act of assembly passed the 15th day of January 1811.

And whereas also since the acts aforesaid on the 20th day of November 1827 the successors of the trustees aforesaid by an order directed the said strip of 40 feet to be laid off in lots and numbered and sold to the highest bidders for the benefit of the trustees which order was on the 1st day of December 1827 carried into effect, and Rufus K. Summers purchased lot No. 87 at the price of $1.68, and obtained from Brookey Barker, the town collector, a certificate of said purchase which acts of the trustees have also been confirmed, and the said Rufus K. Summers assigned same to F. G. Alexander who assigned said certificate to Whitledge Overall.

Now this indenture made this 16th day of January 1829 between Thomas Q. Willson, Matthew Wilson, George W. Jenkins, William Cargrove and Rufus K. Summers, trustees of the town of Shepherdsville of the one part, and Whitledge Overall of the other part.

Witnesseth: that the said trustees for and in consideration of the premises and of the payment of the said purchase money to them made, that receipt whereof is hereby acknowledged have granted, bargained, and sold, and by these presents do grant, sell and confirm unto the said Whitledge Overall, his heirs and assigns all the aforesaid lot No. 87, purchased as aforesaid with allthe appurtenances thereunto belonging unto him the said Whitledge Overall, his heirs and assigns forever, and said trustees for themselves and their successors in office do covenant to and with the said Whitledge Overall that they will forever warrant and defend the title to the said Lot No. 87 to him, said Overall, and his heirs &c against the claim or all persons whatsoever legally claiming or to claim the same. In testimony whereof the said Thomas Q. Willson, Matthew Wilson, William Cargrove, George W. Jenkins, and Rufus K. Summers, trustees aforesaid, have hereunto set their hands and seals this date aforesaid.
