Matthew & Samuel Wilson to Thixton & Hornbeck - Part of Lot 41

On 21 Nov 1836, Matthew and Samuel Wilson sold part of Shepherdsville lot #41 to John S. Thixton and Preston N. Hornbeck as shown below.

This indenture made this 21st day of November 1836 between Matthew Wilson and Martha T. Wilson his wife and Samuel Wilson of the City of Louisville, county of Jefferson, and state of Kentucky of one part and John S. Thixton and Preston N. Hornbeck of Shepherdsville, Bullitt County, and same state of the second part.

Witnesseth that the said M & S Wilson for and in consideration of the sum of $600 payable as follows: $200 by note daed the 20th of April 1836 and payable in one year thereafter with interest from date till paid, and $200 payable in two years from said 20th of April 1836 with like interest, and $200 payable in three years from 20 April 1836 with like interest till paid, the receipt of which they do hereby acknowledge, they said M. & S. Wilson have sold and do by these presents sell and convey unto the said Thixton and Hornbeck the following lot and appurtenances in said town of Shepherdsville, Bullitt County, Kentucky, part of lot No. 41 in the new plan of the town of Shepherdsville except 26 feet 9 inches.

The said lot lies on Main Street and is the same lot on which the store house of said Thixton and Hornbeck is situated, the same lot purchased by said M. & S. Wilson of Benjamin Summers by deed dated the 26 of May 1824 of record in Bullitt County Court office in Deed Book E, page 218, the lot when purchased by said M. & S. Wilson containing a front(?) and now containing a front on Main Street of 55 feet and run back 99 feet 5 inches, but said M. and S. Wilson did on the 15 of July 1829 by their deed of that date convey to Jonathan Gore, see book F, page 103, county court of Bullitt, 26 feet 9 inches by 55 feet on the back part of said lot next to and a front on Main Street of 55 feet and running back about 72 feet 8 inches to the part sold to said Gore with its appurtenances.

To have and to hold said part of lot No. 41 as aforesaid of 55 feet front by 72 feet 8 inches unto them gthe said John S. Thixton and Preston W. Hornbeck and their heirs forever. And the said Matthew Wilson and Samuel Wilson do hereby covenant and agree to and with the said Thixton and Hornbeck that they said M. & S. Wilson will and their heirs shall warrant and forever defend the said 55 feet front and 72 feet 8 inches ack of said lot No. 41 unto them the said Thixton and Hornbeck and to their heirs or assigns forever against the claims of themselves and their heirs and against the claims of all other persons by this herein deed in fee simple with general warranty. And said Thixton and Hornbeck agree and allow the said M. & S. Wilson to retain a lien and they said M. and S. Wilson do hereby retain a lien on the said lot and appurtenances here sold for the payment of the purchase money as aforesaid. Witness the hands and seals of the grantors.
