Isaac Hornbeck to John Anderson - Part of Shepherdsville Lot 41

The Trustees of Shepherdsville had the part of Main Street from the Courthouse Square to Water Street macadamized, and required those whose property fronted on that part of the street to pay the cost. Isaac Hornbeck appears to have owned part of Lot No. 41, and when he refused to pay, the Trustees ordered the town tax collector, William B. Holsclaw, to sell the lot. John Anderson purchased it, as shown below. Anderson would later sell it to William Arnold.

Whereas the trustees of the town of Shepherdsville under and by virtue of an Act of the General Assembly of the Commonwealth of Kentucky directed that Main Street in said town from the public ground to Water Street should be macadamized, and that the owners of the lots and parts of lots fronting said street should pay the expenses thereof and on a failure thereof after the work should be done, that said lots and parts of lots should be sold, or so much thereof as should be sufficient to satisfy and pay the costs and expenses of grading and macadamizing said street, and all costs of advertising and selling the same, which work was let out to the lowest bidder and Thomas Shain became the undertaker.

And whereas also Isaac Hornbeck, the owner of part of lot number 41 fronting said street failing and refusing to pay the amount levied by said trustees on said part by him as aforesaid, William B. Holsclaw, the collector of the said tax was directed to advertise and sell said part of said lot, or so much thereof as should be sufficient to pay and satisfy the amounts so levied and all costs attending the same.

In pursuance of the law and the order of said trustees, the said William B. Holsclaw, collector as aforesaid, did upon advertising as by law directed on the sixth day of April 1835 at the courthouse door in Shepherdsville (the Bullitt Circuit Court being then in session) publicly offer said lot for sale and did then and there sell 49 feet, 10 inches of said part of said lot fronting said street and extending back 99'5" including the house and other buildings thereon for the sum of $117.87 1/2 and John Anderson became the purchaser.

This indenture therefore made this seventh day of April 1835 between the said William B. Holsclaw, collector as aforesaid of the one part and the said John Anderson of the other part.

Witnesseth that the said William B. Holsclaw, collector as aforesaid, for and in consideration of the law, the orders of said trustees, the sale and the power vested in him, hath and by these presents doth sell, alien, release, convey and confirm unto the said John Andeson all the interest, right, title and claim of him the said Isaac Hornbeck of, in and to the part of said lot number 41 sold as aforesaid, being 49'10" front and extending back 99'5" including the house and buildings thereon.

To have and to hold the said described part of said lot with all the appurtenances thereto belonging unto him, the said John Anderson, and his heirs, and to his and their only proper use, benefit and behoof forever. The said William B. Holsclaw, collector as aforesaid, hereby only warranting and defending to the said John Anderson and his heirs the said described premises as far as by law and his office he is bound to warrant and defend and no farther. In testimony whereof the said William B. Holsclaw, collector as aforesaid, hereto sets his hand and seal on the day and year within written.
