John Anderson to William Arnold - Part of Shepherdsville Lot 41

The Trustees of Shepherdsville had the part of Main Street from the Courthouse Square to Water Street macadamized, and required those whose property fronted on that part of the street to pay the cost. Isaac Hornbeck appears to have owned part of Lot No. 41, and when he refused to pay, the Trustees ordered the town tax collector, William B. Holsclaw, to sell the lot. John Anderson purchased it. Anderson would later sell it to William Arnold as shown below.


Bullitt County Deed Book I, Pages 164-165

This indenture made the second day of January 1839 between John Anderson and Roanna his wife of one part and William Arnold of the second part, all of Bullitt County and state of Kentucky.

Witnesseth that whereas on 19 May 1834, Jonathan Gore and others by their deed of that date conveyed to Isaac Hornbeck a lot of ground in Shepherdsville, being all that part of lot number 41 except the 30 feet front thereof on Main Street on which William Arnold now lives, and on 17 April 1835, 49 feet 10 inches front of said Hornbeck's lot was conveyed to said Anderson and said Anderson has sold said ot so owned by said Hornbeck as purchased of Gore &c and conveyed to him (Hornbeck) to said Arnold for the sum of $400. The consideration of this deed paid in hand and said Isaac Hornbeck and Mahala his wife hereby become parties to this deed to relinquish to the said Anderson, their interest, right and title to the whole of said lot of land so purchased of Gore &c unto him the said John Anderson for the consideration of one dollar in hand paid and other consideration secured to be paid.

And they the said Isaac Hornbeck and wife do release, relinquish and convey unto the said John Anderson and his heirs forever all their right and interest in said lot, and covenant to and with said John Anderson to warrant the same to him, said Anderson, forever against the claims of themselves and their heirs and all others.

And now therefore the said John Anderson, for the consideration of $400 to him in hand paid as aforesaid by said William Arnold has sold, and by these presents does hereby sell and convey unto him the said William Arnold and to his heirs and assigns forever all that part of said lot number 41 as aforesaid in the new plan of the town of Shepherdsville except the 30 feet front on the alley now owned and occupied by the said William Arnold, with its appurtenances.

To have and to hold the said part of lot number 41 as aforesaid fronting the Main Street in Shepherdsville unto him the said William Arnold and his heirs and assigns forever.

And said John Anderson for himself, his heirs &c does hereby covenant and agree to, and with the said William Arnold that he, said John Anderson, will and his heirs &c shall forever warrant and defend the lot number 41 so as aforesaid here described and sold with its appurtenances unto him the said William Arnold, and to his heirs and assigns forever against the claim or claims of all and every person or persons whatsoever. Witness the hands and seals of the said Isaac Hornbeck, and wife and John Anderson and wife the date first herein written.
