James P. Oldham to George W. Bowman - One-Fifth of Lot 28

On 30 Aug 1827, George F. Pope, as commissioner, deeded Shepherdsville town lot 27 and part of lot 28 to Matthew Wilson. Wilson sold the part of Lot 28 and the brick house on it to Richard Simcoe as trustee for Henrietta Oldham, daughter of Dr. H. Oldham, as shown below.

Henrietta Wilson, born 22 Apr 1828, daughter of Henry and Eliza Oldham, died of consumption on 17 Oct 1852. She was buried in the Old City Cemetery in Shepherdsville.

She had married the lawyer William Wilson on 27 May 1847, and they had two children, Henry Turner Wilson, born 7 Apr 1848, and Mary who was born 17 Jul 1850, but died 13 Jan 1853, and is buried alongside her mother.

The brick house sat on the southwest corner of Lot 28, and this deed divides the lot, giving to William and Henrietta Wilson the western slice the width of the brick house. The remainder of the lot to the east was allotted to R. B. Simcoe, M. L. B. Simcoe his wife, Henry W. Simcoe, James P. Oldham and John W. Oldham, heirs of Samuel Oldham.

In 1849, James P. Oldham lost his one-fifth share to George W. Bowman in a court case. Then on 6 Nov 1850, John W. Oldham sold his share of Lot 28 to Henrietta Wilson.

This indenture made and entered into this 14th day of May 1849 between Henry C. Thomas, deputy for John Graham, late sheriff of Bullitt County of the first part, and George W. Bowman of the same county and state of the second part.

Witnesseth that whereas heretofore, to-wit, on the 18th day of April 1843 there issued from the clerk's office of the Bullitt Circuit Court upon a judgment obtained in said court an execution fieri facias No. 1148 in the name of J. W. & G. W. Bowman survivors of J. W. Bowman & Co. against James P. Oldham for the sum of $56.84 with interest at the rate of 6% per annum from the 16th of May 1842 and $6.26 cost of suit, which said execution came regularly to the hands of W. B. Hamilton, deputy for John Graham, sheriff of Bullitt County, who returned the same with the following endorsements.

"Came to hand April 20, 1843 at 12 o'clock. W. B. Hamilton, deputy John Graham, S.B.C."

"This execution levied on the interest of defendant in lot No. 28 in the town of Shepherdsville, June 10, 1843, and not time to sell under this execution. W. B. Hamilton, deputy John Graham, S.B.C."

And whereas also on the 30th day of June 1843 there issued a Venditioni Exponas upon the above execution, No. 1264 which was returned with the following endorsements.

"The sheriff will stay all proceedings on this execution until further orders, August 7. 1843; the levy to continue, James P. Oldham to consent hereto and pay costs of stay. J. W. Bowman."

"I James P. Oldham agree to the above, August 7, 1843. J. P. Oldham."

This execution stayed by order by plaintiff in writing and sheriff hath commission for stay $1.37, August 7, 1843. W. B. Hamilton, deputy for John Graham, S.B.C., reference to each of said executions is had. And whereas also on the 18th of March 1848 another Venditioni Exponas No. 529 issued in the following letters and figures, to-wit.

"The Commonwealth of Kentucky to the sheriff of Bullitt County, Greeting. You are hereby commanded to expose to sale the estate of James P. Oldham consisting of the interest of James P. Oldham in lot No. 28, new plan of the town of Shepherdsville to the amount of $56.84 and interest on same at 6% per annum from the 16the May 1842 till paid and $7.17 which according to our command you have taken into your hands and which remains in your hands unsold as you have certified to the judge for Bullitt Circuit Court to satisfy and pay Jacob W. Bowman and George W. Bowman, surviving partners of J. W. Bowman & Co., the aforesaid sum whereof they have recovered execution against the said J. P. Oldham who is convict as appears to us of record, and that you have said sums aforesaid before the judge of our said court at the courthouse in Shepherdsville on he 6th day of May 1848 to pay the said J. W. & G. W. Bowman and have then there this met. Witness, Noah C. Summers, clerk of our said court at the courthouse aforesaid this 18th day of March 1848 and in the 56th year of the Commonwealth. Att. N. C. Summers, clerk."

"The levy was made by W. B. Hamilton, deputy for John Graham, late sheriff, Bullitt County, who will execute this met. Att. N. C. Summers, clerk." Which came regularly to the hands of H. C. Thomas, deputy sheriff for John Graham, sheriff of Bullitt who retained the same with the following endorsements.

"After advertising according to law I sold at the courthouse door in Shepherdsville on the 17th day of April 1848, being county court day, between 11 & 3 o'clock of said day the within described interest, being the one-fifth part of said lot on a credit of three months, and George W. Bowman, one of the surviving plaintiffs being the highest bidder became the purchaser at $55, and I took no bond. Plaintiffs and defendant both failed to select persons to value the premises herein and I selected Charles G. Douglas and Alvin S. Purdy who valued the same after after being sworn, the valuation here filed April 17, 1848. H. C. Thomas, deputy for John Graham, late S.B.C."

"We the undersigned, housekeepers of the county, being called on by the sheriff to value the within described interest, after being first sworn by the sheriff, do value the same at $75 being the one-fifth of said lot No. 28. Given under our hands, the 17 April 1848. C. G. Douglas, A. S. Purdy."

Now, therefore I, said Henry C Thomas, deputy for John Graham, late sheriff of Bullitt County, for and in consideration of the levy, sale and purchase as aforesaid, and a year and a day having expired since the sale without redemption, and by virtue of the authority vested in me by law, have given, granted, bargained and sold, and by these presents do give, grant, bargain and sell, convey and confirm unto the said George W. Bowman, his heirs &c all the right, title, and interest, being the one-fifth, which the said Oldham had in and to the said described house and lot No. 28 in the town of Shepherdsville at the date of the levy aforesaid with all and singular the appurtenances thereunto belonging or in any wise appertaining to him the said George W. Bowman, his heirs and assigns forever.

And the said Henry C. Thomas, late deputy sheriff as aforesaid, does covenant and agree to and with said George W. Bowman, his heirs &c to warrant and defend the title to the one-fifth part of said house and lot No. 28 against the claim of the said James P. Oldham and his heirs and all other persons claiming or to claim the same in any wise as fully and as effectually as he by law and by virtue of his office as sheriff as aforesaid is bound to do and no further, not hereby intending to render himself in any wise responsible in case the said interest one-fifth in said house nad lot or any part or fraction thereof should be lost to said Bowman, or in case he should not be able to hold the same to the amount of his purchase under this deed of bargain and sale. In testimony whereof I have hereunto set my hand and affixed the seal of my said office this day and year first above written. (signed) H. C. Thomas, Deputy for John Graham, late S.B.C.
