Shepherdsville Trustees to George W. Jenkins - Lot 88

After Third Street was reduced from 80 to 40 feet wide, and new half-sized lots were added to the north, the trustees began selling them. As shown below, they sold lot No. 88 to George W. Jenkins who later sold the lot to William Arnold.

Whereas the Legislature of the State of Kentucky by an act passed on the 11th day of December 1793 vested 50 acres of land lying on the north side of Salt River at the falls of said river in Nacy Brashear, Samuel Crow, Michael Troutman, Frederick Penebaker, Benjamin Stansbury, Joseph Brooks and John Essery as trustees for the purpose of laying off a town, in pursuance of which the said trustees laid out the the town of Shepherdsville and made out and returned a plan thereof by which they made Third Street eighty feet wide; and whereas also the successors of the said trustees had a resurvey of said town and made out a new plan thereof by which the said Third Street was reduced to forty feet wide, leaving to the trustees a strip of 40 feet wide in the north of said town, which plan and acts of the said trustees were confirmed by an act of assembly passed the 15th day of January 1811.

And whereas also since the acts aforesaid on the 20th day of November 1827 the successors of the trustees aforesaid by an order directed the said strip to be laid off into lots and numbered and sold to the highest bidders for the benefit of the trustees, which order was on the 1st day of December 1827 carried into effect, and George W. Jenkins purchased lot No. 88 at the price of $20.06 1/4, which acts of the trustees have also been confirmed.

Now this indenture made this 30th day of June 1830 between William Cargrove, Rufus K. Summers, Matthew Wilson, and Thomas Q. Willson, a majority of the trustees of the town of Shepherdsville of the one part, and George W. Jenkins of the other part.

Witnesseth: that the said trustees as aforesaid for and in consideration of the power vested in them by law, and the said sum of $20.06 1/4 current money of the United States to them in hand paid before the sealing and delivery hereof, the receipt whereof is hereby acknowledged have granted, bargained, and sold, and by these presents do grant, bargain and sell, alien, release, convey and confirm unto the said George W. Jenkins, his heirs &c the said lot of land in the town of Shepherdsville, numbered by the said trustees 88 as aforesaid.

To have and to hold the said lot number 88 with all and singluar the appurtenances thereunto belonging or in any wise appertaining unto him the said George W. Jenkins, his heirs &c and to his and their only proper use, benefit and behoof forever. And the said trustees as aforesaid for themselves and their successors in office do covenant to warrant and defend the said lot and appurtenances from the claim or claims of all persons claiming the same unto the said Geroge W. Jenkins, his heirs &c. In testimony whereof the said trustees as aforesaid, hereunto set their hands and seals on the day and year within written.
