James Doyle to Joseph Bowman - Lots 45 & 46

On 27 Jun 1797, Benjamin Summers bought ten lots. Listed here are the lot numbers in the new plan and in parentheses the number in the old plan: Lots 41 (13), 42 (14), 21 (24), 45 (41), 46 (42), 47 (43), 48 (44), 64 (45), 63 (46), 79 (51). Summers then sold lots 45 and 46 to George Saunders on 16 May 1821. Then George sold the two lots to Thomas Sanders Sr. Thomas next sold these two lots to Weir Tilford and Abraham Field Jr. on 15 Jan 1823. In October 1827 Tilford and Field deeded the lots to Jacob Bowman. Jacob Bowman's heirs sold the lots to James Doyle in April 1844. Doyle became indebted to Bowman and in October 1845, he signed a mortgage deed to Bowman as shown in the first deed below. Then, in October 1851, lots 45 & 46 were sold by Doyle to Joseph Bowman as shown in the second deed below.

It appears that Joseph Bowman made an arrangement with the railroad for 66 feet of lot 45, but the deed was not finalized until 1869. Then on 19 Apr 1872, lot 46 was sold by auction to H. Clay Crist.

Whereas Joseph Bowman, Bullitt County, has become my security in a note to Wilford W. Maraman for the sum of $400, and I am otherwise indebted to said Bowman in about the sum of $200 for claims transferred to him by the executors of Jacob Bowman dec'd; and being a desirous to secure to the said Bowman in the payment of the sum so due him as aforesaid and to indemnify and keep harmless the said Bowman, for and on account of his said securityship, I have this day bargained and sold and by these presents do bargain and sell, alien and convey unto him the said Joseph Bowman, the house and lot on which I now reside in the town of Shepherdsville. Also the lot adjoining and lying opposite the residence aforesaid, and the lot on which my tanning establishment is situated, together with all the stock, tools &c now in said establishment and all the leather, shoemaker's tools &c. Also two horses, one a bay called Snip; one sorrel mare and two colts, one 2 years old and the other a yearling, three cows and a calf, and two large beds and one trundle bed and steads and furniture, one bureau and one desk to him the said Joseph Bowman and his heirs forever.

But it is distinctly understood that if the said James Doyle shall well and truly pay to said Bowman the aforesaid sum of $200 and also satisfy and pay said debt to said Maraman for said sum of $400, and save and keep the said Bowman harmless for or on account of his said securityship, then these presents shall cease and be of no effect and the premises and property hereby conveyed shall be reconveyed and revert to and vest in the said Doyle, as fully as though these presents had never been executed. Bullitt County Deed Book M, Pages 343-344

This indenture made the 16th day of October 1851 between James Doyle by Robert F. Samuels, commissioner for him for that purpose, of the one part and Joseph Bowman of the other part.

Witnesseth that whereas in the suit in chancery pending in the Bullitt Circuit Court in the name of Joseph Bowman against James Doyle and Wilford W. Maraman, the said court did by its decree dated the 12th day of October 1847 decree and order to be sold the houses and lots in Shepherdsville, Kentucky known by their numbers 45 and 46 and 29, the two first being the same upon which are situated the tannery establishment of said Doyle, the property of said Doyle, in satisfaction of said decree, and appointed Henry C. Thomas a commissioner to sell said houses and lots and tannery and the said commissioner did advertise said houses and lots as directed by said decree to be sold at the courthouse door in Shepherdsville on the 13th day of October 1851; and on that day at said place said commissioner Thomas attended and sold said houses and lots as ordered in said decree, and George W. Bowman as agent for said Joseph Bowman purchased for the sum of $450 the lots numbers 45 and 46 at the sum of $400 and No. 29 at the sum of $50, and the commissioner made and returned his report of said sale to said Bullitt Circuit Court at the October Term 1851; and the said Court by its order in said cause confirmed said report and sale and appointed Robert F. Samuels a commissioner on the part of said Doyle to convey said land to said Joseph Bowman the purchaser, reference to said suit and the orders, decrees, sale &c in the same will more particularly show.

Wherefore in consideration of the premises, the decree, orders and sale in said cause he said James Doyle by Robert F Samuels, appointed commissioner for that purpose, has sold and conveyed, and by these presents does sell, convey and confirm unto him the said Joseph Bowman and his heirs and assigned forever the said lots numbers 45, 46 and 29 so sold with the appurtenance to the same belonging or in any wise appertaining.

To have and to hold the said described houses and lots and their appurtenances unto him the said Joseph Bowman, and to his heirs and assigns forever against the claim of the said James Doyle, and his heirs, and all others as fully as by this deed said commissioner can warrant title to the same without individual responsibility on said commissioner. Witness the hand and seal of the grantor the day and date first above written.
