Joseph Bowman Heirs to L & N Railroad - Part of Lot 45

Jacob Bowman's heirs sold lots 45-46 to James Doyle in April 1844. Then, in October 1851, the lots were sold by Doyle to Joseph Bowman.

It appears that Joseph Bowman made an arrangement with the railroad for 66 feet of lot 45, but the deed was not finalized until 1869. Then on 19 Apr 1872, lot 46 was sold by auction to H. Clay Crist.

This indenture made and entered into this __ day of June 1869 between the administrator of Joseph Bowman dec'd and his heirs to-wit: George W. Bowman, Augustine Cox and Ellen his wife, Patrick Bowman, John Bowman, Martha A. Bowman, Margaret Ann Bowman, Joseph T. Bowman, G. L. Bowman, H. C. Bowman, Thomas T. Bowman, A. H. Bowman of the first part and the Louisville & Nashville Railroad Company of the second part.

Witnesseth that whereas on the 22nd day of April 1869 there was an order or decree entered by the Bullitt Circuit Court in the equity suit of Joseph Bowman's heirs &c against the Louisville & Nashville Railroad Company decreeing to said railroad company a width of ground of sixty-six feet including the bed of said railroad as a right of way through or over said lots belonging to the heirs of said Joseph Bowman deceased.

Said lots are recognized in the plan of the town of Shepherdsville, Bullitt County, Kentucky, as lots No. 45 & 46. Upon these lots was situated a tan yard erected by the ancestor of the heirs hereto. The lots are treated in the pleadings of the parties hereto as numbers aforesaid and by the said order of the 22nd of April 1869.

R. H. Lansdale was appointed as a commissioner in the case aforesaid to convey the width of ground mentioned to the said railroad company. The consideration paid for the said sixty-six feet of ground through said lots was compromised by the parties at the sum of $425. For particulars of said compromise see paper marked "filed 27 July 1859" signed by George W. Bowman. Said papers filed in the suit of the said Bowman's heirs against said railroad company, and said compromise sums have been settled by said railroad company. This conveyance is ordered.

Now therefore in consideration of the foregoing recitals, this indenture witnesseth that I R. H. Lansdale, commissioner as aforesaid have this day bargained and sold and by these presents do bargain and sell and convey to the said railroad company with covenant of general warranty the said width of sixty-six feet of ground through said lots, and the appurtenances thereon to the said railroad company.

To have and to hold the same unto the said railroad company and their assigns &c forever against the claims of said heirs of the said Bowman deceased, warranting the title to the said railroad company as fully and strongly as a commissioner can do. The suit and orders of court made therein are affixed to and made part of this deed.
